  1. This Agreement sets out the Terms and Conditions of Purchase, (hereinafter referred to as the Terms and Conditions), govern the contractual relationship between 'Users' (hereinafter also referred to as 'You', 'Customer' or 'Client') explaining the rights and obligations of the users of this site (hereinafter referred to as You, the Client, the Buyer) and the Pharmacy 'eFarma.AL Sh.pK' 'registered in the National Business Center NBC in Albania (QKB) with NIPT: L91518030K, with address Rr. Luigj Gurakuqi, Tirana with the website: https://efarma.al
  2. Both parties accept these Terms without reservation. These general terms of sale are the only terms that are applicable and supersede all other written terms or agreements or not.
  3. eFarma.AL has the right to update the website and the Terms and Conditions from time to time. In any case, the changes will be published on this website and will take effect at the time of publication.
  4. eFarma.AL has the right to update the website and these terms of service from time to time, at our discretion and without notice. By law, in no case can the conditions have retroactive effect.
  5. By placing an order online, through the website efarma.al, you accept and agree to all Terms and Conditions. It is your responsibility to provide all information that is accurate read and understand the Terms and Conditions before making any purchase. If you do not agree to the Terms and Conditions, you should not use the services of this site.
  6. eFarma.AL has the right to cancel an order and block access to the site, of one or more entities, due to non-compliance with the Terms and Conditions, or for any other reason.
  7. eFarma.AL reserves the right to deactivate any user account, at any time, if you have not complied or have violated the obligations arising under these Terms and Conditions and relevant laws in force in Albania.

2. Purchase procedure

  1. To make purchases electronically, the Client must be of legal age, over 18 years old; with full legal capacity to act.

3. Products

  1. The client can consult the products on the eFarma.AL website and be informed about their general characteristics. For each product, key information will be provided, such as photo, name and description. eFarma.AL can not guarantee that all data is up to date and without human error. Photos published for the purpose of illustrating products may not always show the characteristics of the actual product. For example, quantity, color, shape, size may not correspond to the data published in the product text.
  2. eFarma.AL is not responsible for any errors or inconsistencies in the product illustration. eFarma.AL will always guarantee the delivery of your order to the destination but can not guarantee the availability of published products. Online store availability is not synchronized with stock in stock. In case of lack of the required product, eFarma.AL undertakes to communicate with the Client as soon as possible by phone or e-mail provided by the Client.
  3. eFarma.AL may decide at any time to modify the products, to deactivate them or to cancel the products for any reason.
  4. The products are owned by eFarma.AL until the payment is transferred in full from the Client.

4. Price of products

  1. The prices shown on eFarma.AL are presented in Lek (ALL), which is the VAT price of the product, and does not include the price for delivery of the product.
  2. eFarma.AL has the ability to modify prices at any time; but in case the price is incorrectly written on one or more products, eFarma.AL will communicate the error to the Customer. The customer is free to choose whether to complete the purchase at updated prices or cancel the order.

5. Delivery Costs

  1. Product delivery costs are determined based on the total value of the order and the location of the Customer. These costs are calculated automatically from the website of efarma.al
  2. The customer agrees to pay the shipping cost, the added value of the price of the ordered products.

6. Execution of the order

  1. On our eFarma.AL website you have the opportunity to consult a variety of products presented on the main page. Other products can be found using the menu to list a product group of a certain category. You can also search directly for a specific product using the search function at the top of the page.
  2. When you find the product you are interested in, you can add it to the cart by pressing the corresponding button.
  3. The customer confirms the purchase by filling in the form with real and accurate data, necessary for the completion of the purchase and delivery of the products.
  4. After confirming the purchase, the Customer is notified by e-mail, which confirms the electronic purchase and contains the order information such as products, quantity, price and order number. This applies if the Customer has written his e-mail. If the Client has not completed his e-mail, then he will be contacted by phone by eFarma.AL to coordinate the delivery of the order.
  5. At any time and without reason eFarma.AL has the right to reject and not execute the order of each Client; in this case, eFarma.AL can notify the Client by phone or email.
  6. eFarma.AL is not responsible for website failure or problems during the purchase process.

7. Creating an account

  1. Part of the procedure to open an account on eFarma.AL consists of setting a user and a password. We recommend that the Client choose a strong password that is difficult to find by third parties and we recommend you.
  2. The client undertakes to keep the password always confidential and not to disclose the password to third parties. There is a procedure to reset your password in case you forget it. eFarma.AL has a system that allows you to create an API-based account with Facebook or Google login information (Login via Facebook or Login via Google).
  3. eFarma.AL assumes no responsibility if orders and purchases are made by other persons in the Client's account, with the username and password. If you believe there has been a security breach, it is the Client's responsibility to notify us immediately so that we can reset your password.

8. Payment

  1. The customer undertakes to pay the value of the order. The customer chooses one of the payment methods made available by eFarma.AL: cash payment, Paypal, Skrill, debit / credit card payment or bank transfer payment.
  2. In case of payment with Paypal, Skrill, debit / credit card payment, the Client automatically connects to the respective payment system.
  3. Customer payment card data is protected from encryption and does not pass through eFarma.AL electronic systems, therefore they are not stored by eFarma.AL. The respective debit / credit card bank is responsible for any positive authorization for transactions in eFarma.AL

9. Delivery of the order

  1. Delivery of products will be done within 2 days for shipments in the territory of Albania and within 7 days for shipments in Kosovo from the moment of sending "e-mail confirming the delivery of the order".
  2. The customer will be contacted by telephone by the carrier within the time described above, to schedule an appointment for delivery of the shipment.
  3. eFarma.AL is not responsible for consequences beyond its control, such as force majeure or carrier-dependent events that may delay or interrupt the delivery of ordered products.
  4. Any delay in delivery or non-delivery may not result in compensation for the Customer or third parties. The customer undertakes to withdraw the products on his own behalf or on behalf of the person for whom the order was placed, at the stated address or location agreed with the carrier.
  5. In case of damaged packaging, the Customer undertakes to refuse to receive the damaged products, specifying the reason for the refusal in the act of receipt and undertakes to notify eFarma.AL immediately.
  6. By accepting the receipt of the order without any observation on the receipt of the products, the Customer acknowledges that the products have been delivered in good condition.
  7. If the carrier does not deliver the products due to the Customer, such as non-compliance with deadlines, or failure to communicate to the carrier the details to undoubtedly locate the address, he loses the right to a refund of shipping costs. In this case, the Client owes the shipping costs for the return of the product; in case the customer has paid in advance will be deducted from the refund of the total order.

10. Cancellation of the order

  1. The customer has the right to cancel his order by notifying eFarma.AL.
  2. The cancellation request will only be considered if the delivery of the order has not already been completed.

11. Return of products

  1. The Client has the right to return the order, in whole or in part, within a period of 14 calendar days from the date of delivery of the order, in accordance with Article 37 of Law 9902, dated 17.04.2008 "On Consumer Protection".
  2. Products must be returned to the address specified by eFarma.AL at the beginning of this document. Returned products must be with their original packaging, intact, unused and accompanied by all accessories and documents proving their purchase on our site.
  3. Products returned defective, damaged or used will not be accepted by eFarma.AL.
  4. In case the Customer notices the characteristics of the delivered product that are not in accordance with those published in eFarma.AL, see 3.a, he has the right to return the product.
  5. The amount paid for the products returned intact will be returned to the customer. The cost of returning the products is borne by the customer.

12. Protection of personal data

a. eFarma.AL manages the personal data of the clients according to Law 9887, dated 10.03.2008 “On the protection of personal data”.

b. The main purpose of personal data processing is:

  • ensure the regular delivery of completed orders through the site efarma.al, therefore the necessary data for delivery will be communicated to our partners who deal with the success of delivery of orders.
  • improve the quality of service by communicating information on completed orders that may be of interest to the customer.

c. The Client has the right to refuse promotional communications from eFarma.AL at any time. Personal data is stored by eFarma.AL and can be disclosed to commercial partners only with the prior authorization of the customer, protected by the password that the customer uses to make electronic purchases, see 7.b.

d. The Client has the right to access, correct, delete his personal data or oppose their processing.

e. The Client can exercise these rights at any time by contacting eFarma.AL.
